계엄령을 영어로는 martial law라고 한다. 비상계엄령은 앞에 ‘비상(非常)을 뜻하는 emergency를 덧붙여 emergency martial law라고 표현한다.
여기에 쓰이는 martial은 라틴어 단어 martialis에 뿌리를 두고 있으며(have its roots in the Latin word), martialis는 ‘Mars’의 형용사(adjective)였다. 이때 Mars는 태양계 행성(planet in the solar system) 중 하나인 화성(火星)이 아니라 로마 신화(Roman mythology)에 나오는 전쟁의 신 Mars를 말한다.
따라서 martial은 지금도 전쟁(warfare), 물리적 충돌(conflict), 군대(armed forces), 무력(military force), 무용(武勇·military prowess), 군인(soldiers) 등을 상징 또는 묘사할 때 사용되고 있다.
이 단어가 영어에 편입된(be incorporated into English) 건 중세 시대(Middle Ages)로, 프랑스어에서 차용됐다(be borrowed from French). 영어로 군법회의·군사재판·군사법원을 뜻하는 court martial에서 형용사 martial이 명사 뒤에 오는 이유는 프랑스어 cour martiale의 어순을 그대로 답습한 것이 고착화된(adhere to the word order and become fixed) 데 따른 것이다.
로마 전쟁의 신이 Mars였다면, 그리스 전쟁의 신은 Ares였다. 그런데 똑같아 보이는 군신(軍神)이었지만, 둘 사이에는 엄연한 차이(distinct difference)가 있었다. Mars는 신중하고 합리적인(be level-headed and rational) 신으로 고대 로마인들로부터 숭배를 받은(be worshiped by the ancient Romans) 반면, Ares는 충동적이고 분열을 일으키는(be impulsive and disruptive) 신이어서 고대 그리스인들로부터 불신을 당하고 경원시되던(be distrusted and shunned) 존재였다. 그래서 일부 학자들은 계엄령을 로마 전쟁의 신 Mars를 인용한 martial law라고 할 것이 아니라 부정적 이미지를 갖고 있던 그리스 전쟁의 신 Ares의 형용사 arean을 써서 arean law라고 해야 마땅하다고 지적하기도 한다.
martial이 들어가는 표현이 많지는 않다. 태권도·유도·쿵후 등 무술을 martial arts라고 한다. martial spirit은 ‘군인 정신’ ‘사기(士氣)’ ‘용맹한 정신’을 뜻한다. martial discipline은 군사적 의미의 행동 규율과 수칙(rules and codes of conduct)을 의미하고, martial music은 행진곡(march) 또는 병사들의 사기를 북돋우는(boost soldiers' morale) 등 군사적 목적으로 만들어진 음악을 지칭한다.
그런가 하면 흔히 쓰이지는 않지만 martial lawlessness라는 표현도 있다. lawlessness는 말 그대로 무법(無法) 상태를 의미하는 것으로, 계엄령을 선포했는데(proclaim martial law) 질서가 아니라 오히려 혼돈을 초래해(result in chaos rather than order) 불안을 악화시키는(worsen the unrest) 사태를 말한다. 대한민국의 현재 상황이 딱 여기에 해당한다.
